Terms of Service

These terms govern your use of Site Engine, a website and marketing service for real estate agents operated by OMG Systems (“we”, “us”). By creating an account you agree to them.

1. What the service is

Site Engine builds and hosts a public website for you, publishes MLS listing data you are entitled to display, captures enquiries from your visitors, and provides an AI assistant that answers visitor questions on your site. We host the site, renew its security certificates and keep it online.

We are not a brokerage and we do not provide real estate advice. Nothing the service produces, including anything written by the AI assistant, is legal, financial or professional advice to you or your visitors.

2. Your account

3. Your content, and who owns it

You own your content: your text, photographs, logo and branding. You grant us only the licence needed to host, display and back it up while you are a subscriber.

You confirm you have the right to use everything you upload, including photographs. You must not upload anything unlawful, misleading, or that infringes someone else’s rights.

We own the platform: the software, templates and designs. Your subscription is a licence to use it, not a transfer of ownership.

4. MLS and listing data

Listing data is supplied by third-party real estate boards and feeds. Your use of it is subject to the rules of the board that supplies it, and to any agreement between you, your brokerage and that board. You are responsible for holding the necessary authorisation.

We display what the feed gives us. We do not guarantee that listing data is accurate, complete or current, and we are not responsible for errors originating in a feed. If a board withdraws access, the affected data stops appearing on your site.

5. Fees, billing and taxes

Prices include applicable Canadian sales tax: the amount shown is the amount charged, and the tax portion is itemised on your invoice.

Payments are processed by Stripe. We do not receive or store your full card number. Subscriptions renew automatically until cancelled. We may change prices on 30 days’ notice; a change never applies to a period you have already paid for.

6. Free periods

We may offer a free period. During it the service is fully available and no payment method is required. When it ends you will be asked to choose a plan. If you do not, your site stays online for a further 15 days, and we will tell you the date. After that the site is taken offline until you subscribe.

Nothing is deleted when a site goes offline for this reason. Your content is retained under section 8 and your site returns as soon as you subscribe.

7. Cancelling

You may cancel at any time from your billing page. Cancellation takes effect at the end of the period you have paid for: your site keeps working until then. We do not pro-rate refunds for partial periods.

We may suspend or end your account if you breach these terms, if payment fails and is not resolved, or if required by law or by a real estate board. Except in cases of serious or unlawful conduct, we will give notice and a reasonable chance to fix the problem.

8. What happens to your data afterwards

After an account ends or is suspended we retain your content for 90 days so it can be restored or exported. After that it is permanently deleted. You may request an export at any time while the account is active or within that 90-day window.

9. Availability

We work to keep the service available and we perform maintenance, but we do not offer a guaranteed uptime commitment. The service depends on third parties, hosting, MLS feeds, payment and AI providers, and their outages affect it.

10. The AI assistant

The assistant answers visitor questions using your site’s content and listing data. It is automated and can be wrong. It does not give real estate, legal or financial advice, and it is not a substitute for you. Your plan includes a monthly conversation allowance; we will tell you before you reach it. You are responsible for what appears on your site, including assistant output.

11. Liability

The service is provided “as is”. To the extent the law allows, we exclude implied warranties, and our total liability to you is limited to the fees you paid us in the 12 months before the claim. We are not liable for lost profits, lost business or lost commissions.

Nothing here limits liability that cannot be limited by law.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. The courts of Ontario have jurisdiction.

13. Changes

We may update these terms. For material changes we will give notice by email or in the application before they take effect. Continuing to use the service afterwards means you accept the updated terms.
